Over the last six months, Bullish and Gibraltar’s financial authorities have worked together to craft a regulatory framework that adapts traditional finance (TradFi) clearing regulations, such as those enforced under EMIR and Dodd-Frank, to the crypto ecosystem.
Dubey highlighted concerns about cryptocurrency, pointing out that Reserve Bank of India (RBI) Governor Shaktikanta Das has consistently stated that cryptocurrencies are not legal tender. Despite this stance, the Supreme Court ruled against restrictions on cryptocurrency exchanges, allowing them to continue operations.
She acknowledged that the last few years have been tumultuous for the industry, with enforcement actions often taking precedence over clear regulatory frameworks. Now, she hopes to provide more definitive guidance and work toward distinguishing which aspects of crypto regulation fall under the SEC’s jurisdiction.
The appointment has been widely interpreted as potentially positive for the crypto market, with Quintenz's experience and digital asset friendliness adding validity to such expectations.
The review also coincides with the introduction of new tax policies targeting undisclosed crypto gains. Starting February 1, 2025, profits from crypto investments will be taxed under Section 158B of the Income Tax Act, typically reserved for assets like money, jewelry, and bullion.
